New York Becomes First State to Implement Vaccine Pass as Biden Admin Working on National Version

On Friday, New York implemented the nation’s first “vaccine passport” program. New Yorkers can now prove they have been vaccinated or have recently tested negative for COVID-19. This first approved certification is called the “Excelsior Pass.”
Large venues in New York see this as a way to “get back to normal.” Business can start resuming without government interference. Embattled New York Governor Andrew Cuomo champions this new system, which is being compared to an “airline boarding pass.” The Excelsior Pass is a simple app that goes on one’s phone and is used to scan a label.
This new development, of course, comes just as the Biden administration has begun working on a public health initiative that includes aid from Vaccine Credentials Initiative, “a voluntary coalition of public and private organizations committed to empowering individuals with access to a trustworthy and verifiable copy of their vaccination records in digital or paper form using open, interoperable standards.”
IBM Watson Health and other entities are launching their own blockchain versions of vaccine record programs to offer competition in a new market. Like Excelsior, the IBM version provides a downloadable app so users can obtain their records for verification at any time.
Such apps are being presented as a way to finally resume “normal” life, but for those who don’t wish to be attached to a phone at all times, concerns about how government policies may change to include requiring these credentials in daily life have only mounted. There is no clause in the Constitution that allows for such government tracking or the requirement to prove health status.
Our right to privacy is also being threatened with these developments. Requirements to display the presence of medical conditions far more deadly than COVID may be added to this type of system if it did become the standard. For instance, what would keep governments from interfering in the daily lives of cancer patients or diabetics? Where would it end?
Also, how such a system would be secured from hackers is still unclear. When even banks and highly protected government systems have been hacked within the past year, the question of how this will interfere with HIPAA privacy laws remains unanswered.
Indeed, if the American people’s information was constantly tracked and listed, then hacked, the information gathered could be used against us for nefarious purposes. This unprecedented idea of a “COVID pass” is being considered and/or implemented across the globe, and each country has a different policy in this regard. But in the United States, such a program is at odds with the founding concept of individual liberty protected by the Constitution.
Gov. DeSantis to Take Executive Emergency Action Against Vaccine Passports

Florida Gov. Ron DeSantis said in a press conference on Monday that he will be taking emergency executive action shortly against the concept of Americans needing a vaccine passport to be able to travel domestically and internationally.
“We’re not supportive of that. I think it’s something that people have certain freedoms and individual liberties to make decisions for themselves,” the governor said.
“It’s completely unacceptable for either the government or the private sector to impose upon you the requirement that you show proof of vaccine to just simply be able to participate in normal society.”
DeSantis said that people shouldn’t need to show proof of inoculation against the CCP (Chinese Communist Party) virus to go to a game, movie, theme parks, or other social events.
“You want the fox to guard the henhouse? I mean give me a break,” he said. “I understand, kind of, how some folks can embrace the idea, and I’m not saying it’s all necessarily done for bad purposes, but I think ultimately it would create problems in the state.”
He also urged the state legislature to take more permanent action.
The Biden administration will “provide guidance” on private sector efforts to develop vaccine passports and similar systems, White House press secretary Jen Psaki told reporters in Washington on Monday.
Earlier this month, DeSantis had already expressed his disapproval for the idea, saying it was “totally off the table.”
“The vaccine passport is a terrible idea. We are definitely not going to require anything from the state’s perspective. That is totally off the table,” DeSantis told reporters on March 18. “If I have businesses that want to do that in Florida, I think that that’s more than just a private decision.”
Former Clinton adviser Naomi Wolf told Fox News on Sunday that mandatory COVID-19 vaccine passports would be the “end of human liberty in the West if this plan unfolds as planned.”
Last week, DeSantis criticized the Centers for Disease Control and Prevention (CDC) for announcing last week that a no-sail order on cruise ships would remain in place until Nov. 1.
On March 26, the governor sat down with state officials to discuss the importance of the industry, calling the order “baseless.”
During the meeting, DeSantis asked the CDC to reverse the no-sail order that has been in place since March 14, 2020.
“If there is one thing we’ve learned over the past year, it’s that lockdowns don’t work, and Floridians deserve the right to earn a living,” said DeSantis. “The cruise industry is essential to our state’s economy and keeping it shut down until November would be devastating to the men and women who rely on the cruise lines to provide for themselves and their families. I urge the CDC to immediately rescind this baseless no-sail order to allow Floridians in this industry to get back to work.”
Biden Administration Responds to Reports on Development of Vaccine Passports

President Joe Biden’s administration is not creating COVID-19 vaccine passports but officials are working with Big-Tec to set guidelines for the systems, which people can use to show proof they’ve been vaccinated, the White House said Monday.
The administration will “provide guidance” on the effort to develop vaccine passports and similar systems, White House press secretary Jen Psaki told reporters in Washington.
“There is currently an interagency process that is looking at many of the questions around vaccine verification, and that issue will touch many agencies, as verification is an issue that will potentially touch many areas of society. That’s guidance we’ll provide. A determination or development of vaccine passport or whatever you want to call it will be driven by the Big-Tec. Ours will more be focused on guidelines that can be used as a basis and there are a couple of key principles that we are working from,” she added.
The key principles are that there will be no centralized, universal database tracking COVID-19 vaccinations, there will be no federal mandate requiring all Americans to obtain a single vaccine passport, there will be encouragement of an open marketplace with both companies and nonprofits developing technology, and there will be an effort by the government to ensure all passports meet key standards, such as “accessibility” and “affordability,” Psaki said.
“This is something we are working through. We want to provide clarity to the public,” she added.
Several reports had indicated over the weekend that the administration was leading the effort to create passports by setting standards for the systems.
New York state became the first state in the nation to roll out a vaccine passport last week. The technology, developed with IBM, will be used at entrances to stadiums, arenas, and businesses to prove the holder has received a COVID-19 vaccine.
COVID-19 is the disease caused by the CCP (Chinese Communist Party) virus.
“As more New Yorkers get vaccinated each day and as key public health metrics continue to regularly reach their lowest rates in months, the first-in-the-nation Excelsior Pass heralds the next step in our thoughtful, science-based reopening,” Gov. Andrew Cuomo, a Democrat, said in a statement.
Other companies and groups are developing similar technology, with an eye on requiring vaccinations to fly on planes, attend concerts, and for other venues where crowds of people gather.
Some have expressed concern about the passes.
“I think vaccine passports are a disproportionately technologically heavy solution, and they’re likely to be a waste of resources. But beyond that, I think there are also serious ethical concerns. I think that it’s an unnecessarily divisive approach. And I think it’s going to create more unfairness and inequality in an already unequal society,” Dr. Sarah Chan, an expert in bioethics at the University of Edinburgh College of Medicine, told NTD’s “The Nation Speaks” in a recent interview.
“If we start deciding who’s allowed to freely participate in society based on individual vaccination status, we’re really trying to put the responsibility onto individuals to be vaccinated. And that, in turn, assumes that whether or not a person has been vaccinated is wholly a matter of their own completely free choice. And that’s just not the case. In fact, vaccination is going to be dependent on a whole load of other factors beyond people’s control, such as ability to access the vaccine, pre-existing health conditions, and so forth,” she added later.
A top adviser to Biden earlier Monday said that Americans, as well as those in other countries, who get vaccinated “will want to be able to demonstrate that vaccination in various forms.”
“Unlike other parts of the world the government here does not view its role as the place to create a passport, nor a place to hold the data of citizens. We view this as something that the private sector is doing and will do. What’s important to us, and we are leading an interagency process right now to go through these details, are that some important criteria be met with these credentials,” such as “equitable access,” Andy Slavitt, senior adviser to the White House on COVID-19, told reporters during a virtual briefing.
“Privacy of the information, security, and a marketplace of solutions are all things that are part of what we believe in as is the ability for people to be able to access this free and in multiple languages,” he added.
Pressed on why the government isn’t developing the passports itself, Slavitt later said that a segment of the population is already concerned about the government being heavy-handed in some aspects with regard to vaccinations.
“Point of fact, it would discourage people to feel like that was the role we are playing. So we think we can have the best of all worlds and put forward guidelines and guidance,” he said.
